Johnson Kelley Associates TDLR and ADA Accessibility Compliance

IMPORTANT NOTICE: On 9/8/2025, the TDLR issued new requirements placed
on the owner to move forward on all active projects.
A building owner, per Texas Government Code Sec. 469.058, is responsible for any violation of the Elimination of
Architectural Barriers program laws or rules and may be subject to administrative penalties for any violation. An employee of
the person(s) that hold title to the constructed property are considered the owner. Parent entities, owning partners, or other
employees cannot sign on the Owner’s behalf without either the TDLR Owner Agent Designation Form or the TDLR Limited
Liability Ownership Form on file.

● CAD Document is required for all projects to proceed through the required steps of plan review and inspection, as
well as all other project updates.
The CAD# County Appraisal District website document for the property is a PDF document that must be provided prior to
registering or updating the project on TABS. This PDF document must have Parcel ID (CAD#), Parcel address, Owner, and
Owner address. It is printed from the property page on CAD website.
● Limited Liability Ownership Form (LLO) is required for certain ownership type structures.
The LLO form is only required if the CAD Owner’s legal structure is a LP, LLP, LLC type of entity.
Disregard if not applicable.
Also required: Articles of Formation (AOF) or Texas Secretary of State (SOS) document for this type of owner entity.

Johnson Kelley has provided accessibility consulting services for the past 33 years and would welcome

We provide pre-purchase due diligence services to assist clients in assessing properties and identifying
potential liabilities under the ADA that may result from acquiring older properties. Ultimately it is the current or
new Owner of a property that will inherit accessibility liability.

We strive to make adhering to the requirements of the Texas Department of Licensing and Regulation
(TDLR) Architectural Barriers Program an efficient process. Refer to the contact information located to the right
for our personnel and their area of focus. Keep in mind that each member of our team can assist you should one
of our team members be unavailable. Kelly Hartman is who handles accounting but the rest of our staff are able
to perform any other administrative function needed so there will always be someone available to assist you with

Johnson Kelley Associates has performed plan reviews and inspections for projects in Texas since 1995.
We got in on the ground floor of the State’s use of outside contractors to help administer the AB Program. Johnson
Kelley principals and inspection staff attend the TDLR Texas Accessibility Academy each year to receive the
latest information and interpretations from the TDLR regarding accessibility requirements. Prior to 1995 Jeff did
extensive consulting for ADA compliance leading up the 1992 ADA landmark Federal Civil Rights legislation.

We can provide the fastest review possible with a complete submittal. The TDLR requires us to have a
complete submission prior to performing the work. We recommend submitting your project in one package, if
possible. Sending drawing PDF files and required forms days apart or information in various emails can delay the

● Preferred Inspection Scheduling
The TDLR requires a post-construction inspection within one year of the project’s completion, and we
work closely with our clients to schedule timely inspections. We prefer to be onsite as soon after substantial
